The Supreme Court refused Josh DuggarThe appeal related to his conviction on child pornography charges while he was still serving a prison sentence.
The court made the decision on Monday, June 24, and did not elaborate on the rejection, according to it Associated Press. The update comes after the United States Court of Appeals for the Eighth Circuit voted to uphold Duggar’s conviction in October 2023.
Duggar, 36, who is serving a child pornography sentence at FCI Seagoville in Texas, will be released in 2032. He was originally arrested on charges of receiving and possessing child pornography in 2021. He pleaded not guilty and was later sentenced to 151 months in prison.
The reality star was previously in the spotlight thanks to her family’s TLC reality series 19 Children and Counting. In 2015, Josh was attacked after a police report said he molested five girls, four of whom were his sisters, when he was younger. His name was also mentioned in the infamous Ashley Madison leak, which included information linking Josh to a website created to help people have affairs.
“I have been the biggest hypocrite. Josh and Anna remained married and raised their family with seven children. Anna also continued to show support for her husband during his trial and appeared in court for his sentencing.
After his conviction, Josh spent two months in the Washington County Jail in his home state of Arkansas before being transferred to FCI Seagoville, where he is subject to strict rules that do not include unsupervised visits with his seven children.
“The defendant will have no unsupervised contact with minors,” court documents obtained by Us Weekly in June 2022 stated. “If there is concern about the potential for inadvertent contact with minors at a particular venue, function or event, the Defendant shall obtain approval from the US Probation Office prior to attending such venue, function or event.”
During his time at FCI Seagoville, Josh was allowed four hours of visits per month. He could only exchange “handshakes, hugs, and kisses (in good taste)” with Anna at the beginning and end of the visit.
The legal document notes that after Josh’s release, he cannot “own, use, or have access to a computer or other electronic device with Internet or photo storage capabilities without prior notice and approval from the US Probation Office.”
Duggar’s lawyers filed an appeal in October 2022 with a request for a new trial. During the February 2023 hearing, attorneys Justin Gelfand It was alleged that Duggar’s phone was seized while trying to contact legal representation when federal agents raided his business premises before his April 2021 arrest. The United States Court of Appeals responded that Duggar “voluntarily agreed” to be questioned.
In her appeal to the Supreme Court, Duggar specifically alleged that police in Arkansas found child sexual abuse material shared by a computer that was traced to her.
Duggar’s argument was that her attorney should have been able to question the previous sex offense convictions of former dealership employees who had used the same computer. His legal team did not ask the former employee to testify after a judge ruled he could not mention his previous convictions.
