Suggests comments on ethical failures as ‘dangerous rhetoric’
The Connecticut Bar Association is warning lawyers against criticizing President Donald Trump’s political claims because it could amount to “dangerous rhetoric.”
The association recently sent a message to members signed by Maggie Castinado, its president, James T. Shearin, president-elect, and Emily Gianquinto, vice president.
They warned against “reckless words” that attack the integrity of the country’s judicial system.
They demanded, “After the recent trial and the wrath of former President Donald Trump, public officials have issued statements declaring that the trial is a ‘sham’, ‘hoax’ and ‘rigged’; our justice system is ‘corrupt and rigged’; judges it is ‘corrupt’ and highly unethical’; and, that the jury was ‘partisan’ and ‘precooked.'”
There has also been a comparison with the communist “showing” trial, which was accused of guilt and the trial court only to make it appear from the court process.
The bar claims, without noting whether the allegations are, in fact, true, the claim is “unsubstantiated and frivolous.”
And they can “provoke acts of violence against” members of the court. Moreover, they ‘spread public distrust of the judiciary … .
The comments, the association claims, “cross the line from criticism to dangerous rhetoric.”
Efforts to prevent the speech did not fit the politics of the association as some Democratic prosecutors continued to attack Trump.
Already, Arthur Engoron, a judge in New York, has demanded a penalty of nearly half a billion dollars for the way Trump negotiated loans for his company, a practice that industry insiders described as routine. In fact, no one lost money or complained and the bankers involved wanted to do more business with Trump. And the Manhattan District Attorney, Alvin Bragg, took the allegations of misreporting of businesses that had passed the statute of limitations and claimed that they were crimes because they caused unspecified crimes. A left-leaning jury in New York convicted Trump in a decision that is now on appeal.
Several other cases, such as the alleged improperly appointed prosecutor and another with an ethical cloud because the DA had hired her paramour, with taxpayer money, to carry out the charges against Trump, have significant obstacles.
Now Jonathan Turley, the Shapiro Professor of Public Interest Law at George Washington University, an expert witness on the law before Congress and a popular commentator, said that the message from the association is “horrifying” for lawyers who see the law against Trump as “raw”. political demands.”
He noted that officials demanded “members to speak publicly to support the integrity of the legal process.”
He noted another fact.
“For example, criticizing Judge Juan Merchan (who heard the business record case) for refusing to recuse himself from the case is considered beyond the pale.”
However, he noted, “Many lawyers believe that political (financial) contributions to Biden and his daughter’s leading role as a Democratic fundraiser and activists should ask Merchan to remove himself (and there is a conflict).”
His own opinion is that Merchan’s decision is biased.
He said the verdict should be overturned, and he blamed not the jury “but the judge and the prosecutor for the baseless and unfair trial.”
He identified the problem with the bar’s request as “the suggestion that lawyers are acting in an unprofessional manner while arguing against what many see as a two-tier system of justice and the politicization of our legal system.”
Evidence?
“Notably, the bar officials did not write to condemn the attacks on figures like Bill Barr or to claim that the Justice Department did justice during the Trump years.” In addition, the official never issued a warning about attacks on conservative judges and labeled them “rebel sympathizers.”
No worries bar when Sen. Richard Blumenthal, D-Conn., threatens judges with “seismic changes” or Sen. Chris Murphy, D-Conn., called the Supreme Court “corrupt.”
“In the same way, Senate Majority Leader Chuck Schumer also announced in front of the Supreme Court ‘I want to tell you, Gorsuch, I want to tell you, Kavanaugh, you have unleashed a whirlwind, and you will pay the price,'” he continued.
He noted the letter “only reinforces the view of a legal system that maintains orthodoxy and a political agenda.”
