The prosecutor Sean “Diddy” Combs‘ The ongoing lawsuit denies he intentionally leaked footage of the abusive rapper physically assaulting his ex. Cassie in 2016.
In court documents filed on October 30, and taken by Us Weekly, prosecutors against Diddy’s request to order jokes related to the video.
“The Court must deny the Leak Motion for the simple reason that the defendant failed to show the jury leaked the material,” the court document read. “Without any factual basis, the Leak Motion seeks to suppress the most probative evidence – a video of Combs brutally assaulting a victim in March 2016 that was published by a media outlet in May 2024 – by claiming that the material was grand jury material leaked by Government agents to CNN. “
The motion added, “However, as the defendant is aware, the video was not in the government’s possession at the time of CNN’s publication and the Government has never obtained the video through the grand jury process.”
Diddy’s trial is currently scheduled to begin in 2025 with his lawyers trying to keep the CNN tapes out of court.
“The defendant is grasping at straws. Because the defendant cannot show that the information in the Cited Article was grand jury material, and because he cannot show that a Government agent who had access to the grand jury material leaked the information, he cannot establish the requisite prima facie showing for the relief sought,” prosecutors added in court documents, denying leaking other sensitive material to other news outlets. In addition, although any information in the Cited Article may be considered non-public information that was not properly disclosed, the defendant’s request for relief under Local Criminal Rule 23.1 is supported by the order made by this Court on October 25, 2024.
In the document, the lawyers also expressed “serious concerns” about Diddy’s victims and court witnesses.
“Here, as detailed in the indictment and at the bail hearing, the defendant has a significant history of violence and obstruction,” the filing said. “Indeed, Judge Carter found by clear and convincing evidence at the conclusion of the second hearing, the defendant ‘is a danger in terms of obstruction of justice and interference with witnesses’ and ‘is a danger to the safety of others in the wider community.’ Because of the defendant’s history, the Government has serious concerns about victim safety and the possibility of witness tampering if a list of victims’ names is provided to the defendant.
CNN obtained and published video in May showing Diddy, now 54, grabbing Cassie, now 37, by the neck, driving, dragging and kicking her repeatedly while in a Los Angeles hotel. The recording is timestamped from 2016.
Within hours, Diddy apologized for his actions without mentioning Cassie (full name Casandra Ventura) directly.
“It’s hard to describe the darkest moments of your life, sometimes you have to do it,” she said in an Instagram video. “I’m f—ed up. I mean, I hit rock bottom but I’m not making excuses. My behavior in that video is inexcusable. I take responsibility for my actions in that video. I’m disgusted.”
Diddy added, “I went and got professional help. I’ve been going to therapy, going to rehab. Gotta ask God for mercy and grace. I’m sorry, but I’m committed to being a better person every day. I’m not asking I’m sorry.
Diddy and Cassie dated on and off between 2007 and 2018. Five years later, Cassie sued the music mogul in November 2023 for sexual assault and physical abuse that allegedly occurred over a 10-year period. Diddy vehemently denied all allegations before he and Cassie settled the suit within a day.
Diddy was indicted by a grand jury in September, shortly before he was arrested and charged with sex trafficking, racketeering, conspiracy and transportation to commit prostitution. The 14-page indictment, which also cites a CNN video of Diddy and Cassie, alleges that the rapper allegedly “tortured, threatened and coerced women and others around him” for decades.
Diddy pleaded not guilty to the charges before a judge denied him bail in three separate attempts. He is being held at the Brooklyn Metropolitan Detention Center pending trial.
“We are disappointed with the decision to pursue what we believe to be an unfair prosecution of Mr. Combs by the US Attorney’s Office,” Diddy’s lawyer. Marc Agnifilo toward Us Weekly in a statement earlier this month. “Sean ‘Diddy’ Combs is a music icon, self-made entrepreneur, loving family man and proven philanthropist who has spent 30 years building an empire, worshiping his children and working to uplift the Black community. He is an imperfect man, but he’s not a criminal.”
