While awaiting election results, the media and election officials often refer to late-arriving ballots as “military votes.” This is a misnomer. Special absentee voting privileges, previously reserved for the military, were expanded to include US citizens living abroad, even those who have never lived in the United States.
According to Heather Honey of Verity Vote, UOCAVA requires states to allow members of the U.S. Armed Forces, family members, and U.S. citizens living outside the U.S. to register and vote absentee in elections for Federal office. There was broad support for programs that allowed service men and women to exercise their right to vote, but this was not the primary outcome of the UOCAVA program.
Prior to 2016, the majority of voters exercising the privileges associated with UOCAVA were military voters. This program has been drastically expanded through the use of electronic Federal Post Card Applications and now dominated by non-military demands. The application does not require identity or citizenship verification before registering or receiving a ballot, and no eligibility verification is required before voting.
In 2020, uniformed service members and eligible family members 37% of the UOCAVA ballot return to the country. More than 63% of the returned ballots were attributed to non-military overseas participants.

To verify identity and eligibility and to determine if the application is valid, the Federal Help America Vote Act (HAVA) establishes minimum standards. Applicants seeking to vote in federal elections must provide, when registering, a valid driver’s license number. If an individual has not been issued a driver’s license, they can use it the last four digits of the social security number (or if you don’t have it, the State can give you a unique identification number and verify your identity and have the right to use other approved documents).
In direct conflict with federal and state law, Commonwealth Defender Secretary Al Schmidt or Deputy Election Secretary Johnathan Marks, or both, have issued directives and guidance to county officials to exempt UOCAVA applicants from all verification requirements.
The Defendants’ non-verification position has been confirmed in their sworn testimony before the General Assembly.
When asked about how UOCAVA applicants are verified at the PA House 2022 hearing, Deputy Secretary of Elections, Johnathan Marks, testified: “That group of voters is specifically exempted from the HAVA verification requirements. They do not have to provide a PennDOT ID or the last 4 SSNs. There is no systematic verification ,” he said boldly.
The non-verification positions by the Defendants in the case, PA Secretary of State Al Schmidt and Deputy Secretary of Elections Jonathan Marks are also confirmed in the 2023 Pennsylvania Military and Foreign Affairs Voter Guide, which includes the “position” of the Department of State.
“The Department’s position is that the electorate is closed exempt of ID card requirements for absentee voters.”
Defendants cannot cite any legal authority, statutory or otherwise, as a valid legal basis for the protected “position” of voters exempt from identification requirements because no such exemption exists in state or federal law.
According to the lawsuit:
Commonwealth practice is the election process is structured illegally which makes Pennsylvania elections vulnerable to ineligible votes by individuals or entities who may purport to be UOCAVA-eligible, register to vote without verifying their identity or eligibility but receive ballots via email, and then vote their ballots without providing identification at any step in the process .
