The father of a trans athlete at a New Hampshire high school is asking for a non-prison sentence on charges of distributing child pornography, citing his advocacy for his trans daughterās fight to play in girlsā sports in a letter to a federal judge.
Marc Jacques, the father of trans New Hampshire high school athlete Maƫlle Jacques, was sentenced on September 9 to 60 months in federal prison, according to court documents obtained by Fox News Digital. The U.S. Probation Office allowed him to complete his affairs before reporting to prison in December.
In a letter to US District Judge Paul Barbadoro, Jacques said that collaboration with the ACLU and GLAAD is important to support MaĆ«lleās fight to continue playing on womenās sports teams.
He notes in the letter that MaĆ«lle does not have the support of MaĆ«lleās mother because of MaĆ«lleās transgender identity. Jacques wrote that he has had full custody for the past several years, making him the sole support system for MaĆ«lle and MaĆ«lleās brother, Remi.

āAs a transgender teenager, MaĆ«lle has had a very difficult time finding acceptance and trying to love herself. Since the spring of 2023, MaĆ«lle has faced online bullying, vicious attacks on social media and has been the subject of discrimination in pamphlets distributed in the school district. we are just an example,ā wrote Jacques.
āBefore finding joy in school sports, MaĆ«lle suffered from anorexia, depression and anxiety and self-harm (cutting). More anxiety and self-harm episodes,ā he said.
MaĆ«lle also sought medical advice about gender transition treatment, her letter noted, āand with her mother opposed to gender-affirming medical treatment, I was Maelleās sole support system.ā
āThe Pediatric Endocrinologist at DHMC is also exploring the option of providing a medical opinion that the gender dysphoria that MaĆ«lle suffers from can be declared a disability, especially in the context of a sports ban,ā wrote Jacques.
āThis potential option is another example of MaĆ«lle needing my support and care because her mother and stepmother would oppose this option and any other options that could lead to MaĆ«lle playing high school sports.ā
Maƫlle also sent a letter to the judge asking for a non-custodial sentence for Jacques, saying that Jacques had been attending group therapy and rehabilitation for his crimes.
āIf I canāt stay with him because of the prison sentence, it will be a major attack on my own mental stability because I will lose the home that I see and the security that I feel inside it, as well as the sense of security. The support from him that I just donāt get from my mother ,ā wrote MaĆ«lle. āThe work that has started with the ACLU about my existence as a trans girl in sports also depends on the moral support during the testimony and the meeting with the Senator. The prison sentence will also destroy me and my brotherās future when we will stop receiving support for the payment of tuition without a salary. ā
The judge has yet to decide on a non-custodial sentence for Jacques.

Prosecutors allege Jacques shared child sexual abuse material online
According to court documents obtained by Fox News Digital, Jacques pleaded guilty to one count of distributing child pornography.
In February 2022, authorities began investigating several CyberTips reported to the National Center for Missing and Exploited Children (NCMEC) by MediaLab/Kik, prosecutors wrote in court documents. The platform alerted that a user named āwayne9985ā had uploaded 49 files that appeared to depict child sexual abuse material (CSAM) to other users via private messages between November 24 and December 6, 2021.
Investigators identified Jacques as the user behind the Kik account after tracing IP addresses linked to several uploads, including one from his home in Newbury and another from his girlfriendās place in Hopkinton. Further inquiries revealed that Jacquesā home IP address had been linked to more than 40 previous CyberTips reported by Reddit, Google, Tumblr, and sendvid from 2018 to 2022. A search of Jacquesā Kik account revealed that he had distributed at least 26 CSAM files via messages in person on various dates in November and December 2021.

MaĆ«lleās high-profile battle with New Hampshire law
MaĆ«lle, a student at Kearsage High School in New Hampshire, is nearly 6 feet tall, according to some reports. Jacques was allowed to play for Kearsage Regional despite a state law in New Hampshire that restricts transgender inclusion in girlsā sports. However, a federal judgeās ruling in September put MaĆ«lle back on the field and into the locker room with other female athletes.
New Hampshire Governor Chris Sununu signed on House Bill 1205also known as the āJustice in Womenās Sports Act,ā became law in July, which prohibits trans girls and women from competing in girlsā and womenās sports teams. But then MaĆ«lleās family, along with the families of other transgender athletes, sued to block it.
The federal court issued a preliminary injunction on September 10, which means both athletes will be allowed to play until a final decision is made. A final decision has not been made, so they continue to play despite the law of the country.
The judge who made the ruling, Landya McCafferty, is a liberal who was appointed to the bench by former President Obama in 2013.

Jacques was arrested again on Friday, according to local reports, and accused of taking more illegal pictures after the sentence.
Probation officers reported that pretrial internet monitoring reports showed Jacques accessing data storage devices, which appeared to contain more videos of child sexual abuse material, around August 10 and September 16.
Court documents reportedly show that an arrest warrant was issued for Jacques, leading to his re-arrest on Friday. He is scheduled to be arraigned Monday in U.S. District Court in Concord.
