The Napa County District Attorney is investigating Artem Chigvintsev‘s domestic violence case ahead of November 4 arraignment.
DA Spokesperson of Napa District Carlos Villatoro told TMZ on September 4, that the office examined the case of Chigvintsev before the professional dancer was charged. According to Villatoro, the DA should review witness statements, footage from the incident and additional evidence from the police investigation.
Once the full review is complete, the office will announce publicly how it will move forward, per outlet. Chigvintsev’s trial is now scheduled for November 4.
Us Weekly confirmed that Chigvintsev, 42, was arrested on August 29 in Napa County, California, for domestic violence. At Dance With The Stars Pro was taken into custody and bail was set at $25,000. He was released later that evening.
Chigvintsev was arrested on charges under section 273.5(a) of the California Penal Code, which relates to an individual who has harmed a spouse, partner or parent. If Chigvintsev receives a felony conviction he could face up to four years in state prison and a maximum fine of $6,000. If convicted of the misdemeanor, Chigvintsev could face up to a year in jail and a maximum fine of $6,000.
According to a 911 dispatch tape obtained by TMZ on Friday, August 30, Chigvintsev called 911 asking for medical attention. On the phone, he accused his wife Nikki Garcia of throwing a shoe at him during an alleged altercation.
A few minutes after the call, Chigvintsev tried to cancel the 911 request, saying that medical attention was not needed. The police then arrived at the scene where they found a man with visible injuries. It has not been confirmed whether Garcia, 40, was the injured party. (The couple, who married in August 2022, share their 4-year-old son Matteo.)
Napa Valley Sheriff PIO Henry Wofford told us that the victim “requests complete confidentiality.” The sheriff added, “We also had the opportunity to speak with the victim and the suspect was arrested without incident.”
Chigvintsev “did not fight or fight” during his arrest. The sheriff noted that the investigation is ongoing.
After news of Chigvintsev’s arrest, Garcia broke his silence, asking for privacy.
